Sampling Basics: Chopping, Pitching, Time-Stretching, and the Honest Legal Position

How to chop, pitch and time-stretch samples so they sit in your track, plus a straight explanation of what clearance actually requires when you sample a commercial recording.

Sampling is two skills at once. The creative one is making a fragment of somebody else's recording sound like it belongs in yours. The legal one is unavoidable: if you sample a commercial recording and release it, you need permission for both the recording and the composition, and there is no reliable duration below which you are safe.

Chopping

A chop is a decision about where a musical event starts. Two approaches:

Transient chopping. Slice at every drum hit or note onset. Best for breakbeats and anything percussive. Each slice becomes a playable pad or note, and the original groove is recoverable but also destroyable — which is the point.

Phrase chopping. Take a half-bar or one-bar musical phrase and treat it as a loop. Best for melodic material, chord stabs and vocal lines.

Practical details that separate clean chops from clicky ones:

  • Zero-crossing. Cut where the waveform crosses zero, or apply a 1–3 ms fade at the start and end of every slice. Cutting mid-waveform produces a click.
  • Keep a little pre-roll. Slicing exactly on the transient often cuts off the attack. Start 2–5 ms early.
  • Do not over-quantise the chops. Part of what makes a sampled loop feel human is the original timing. Snapping every slice to the grid removes exactly what you sampled it for.

Pitching

Pitching a sample up or down changes its character, not just its key.

  • Pitching down lengthens the sample, darkens it, and makes drums heavier. Classic in hip-hop, and the reason so many chipmunk-free soul chops sit an octave or a fifth below the original.
  • Pitching up shortens and brightens. Above about 5 semitones, vocals develop the chipmunk formant problem unless the algorithm preserves formants.
  • Small amounts change feel. Pitching a drum loop down 1–2 semitones without time correction slows it slightly and drags the groove, which can be exactly the feel you want.

Decide up front whether pitch and tempo should be linked (tape-style, musical and characterful) or independent (clean, modern, sometimes sterile).

Time-stretching

Every algorithm makes a trade. Match it to the material:

Stay within roughly 15 percent of the original tempo where possible. Beyond that, artefacts become the sound — sometimes usefully so, often not. If a sample is far from your tempo, consider changing your project tempo instead of stretching the sample.

Layering a clean drum sample under a heavily stretched loop hides a lot of damage, because the ear locks onto the sharp transient and forgives the smeared one underneath.

This is not legal advice, but the mechanics are well established:

Two separate rights. The sound recording (the master, usually the label's) and the composition (the song, usually the publisher's and songwriters'). Clearing one does not clear the other. Both must be cleared for a commercial release.

No safe amount. The Sixth Circuit in Bridgeport Music v Dimension Films (2005) rejected a de minimis defence for sound recordings. The Ninth Circuit in VMG Salsoul v Ciccone (2016) accepted one. That split has never been resolved by the Supreme Court, so the answer depends on jurisdiction. Treat "it is only two seconds" as a hope, not a rule.

Interpolation is different. Replaying a melody yourself avoids the recording right but still requires the composition right.

Clearance is expensive and slow. Labels and publishers may ask for an advance plus a percentage of the master and a share of the publishing, and they can simply say no. Well-known recordings are the hardest.

The practical alternatives are royalty-free sample libraries, licensed sample packs, samples you record yourself, and public domain recordings — checking the terms in each case, because a public domain composition can still have a copyrighted recording.

Splitting stems out of a commercial track for study or for a private remix is technically straightforward, and modern separation tools make it easy. That does not create any rights in the result. Owning your export is not the same as owning what you sampled.
